The terms and conditions (hereinafter, the “Contract Terms”) regulate the intermediation service by which Medical Response International S.L.U. makes available to the patient, (hereinafter “the patient user”), for their contracting, the products and / or services provided by the Provider of the medical care service (hereinafter “Provider of the medical service”).

 By using the DrNear.Me website, the user accepts the contract terms and privacy policy, as well as the functionalities and conditions of the services offered here. Likewise, by checking the acceptance box of the contracting terms during the purchase of medical assistance services, you imply acceptance of these terms, as well as the privacy policy.

DrNear.Me may limit, suspend or withdraw the access of the patient user who violates the rules established herein. The patient User undertakes to make correct use of the Web in accordance with the Law and these Conditions, its breach will make the patient user respond to DrNear.Meand / or third parties for the damages caused, prohibiting or denying access to the website and the services offered. The patient user is responsible for the truthfulness of the information that they provide us through different channels, forms, records, etc., as well as their access codes for the use of the services, products and functionalities of the website.

Any fraudulent use of the services offered, identity theft, simulation of symptoms on behalf of the registered patient user, both in face-to-face medical services and in video consultations by phone will be the user’s total responsibility against all the injured parties.


Medical assistance services are provided by third parties outside of DrNear.Me who offer and sell medical assistance services.

Electronic contracting

DrNear.Me manages and offers a platform for users, patients and doctors / medical centers / hospitals, the latter being the ones who offer their services as final service providers, receiving their full fees according to their price list. And at the same time, the needs of the patient user are satisfied by the contracted medical service.

The contactractual relationship will be stablished between the patient user and doctors / medical centers and hospitals, which are reflected in the contract terms and privacy policies, the conditions, descriptions, circumstances that the service provider requires, both of face-to-face medical services and remote medical consultations.  


The language in which the contracting procedure will be processed and in which this contract is formalized will be, unless otherwise indicated, Spanish or English.

Steps of buying online

1.     The patient User on the website will select the products and / or services that interest him such the closest location, date, hours, will review their descriptions, rates, conditions, the final price.

2.     The patient user will enter the personal data requested and start the electronic purchase process that ends with Finalize the order, and express acceptance of the terms of contract and privacy policy, checking the box for this purpose.

3.     The patient user may choose to pay for the medical service or use their travel insurance, if provides adequate coverage for medical expenses.

4.     At the end of the order, an email will be sent with the purchase confirmation. In the case you do not receive it, you should contact us by phone or email. It is mandatory to provide a valid email in order to receive the purchase confirmation.

Acceptance of the appointment, time and day of the medical service by the service provider is necessary to obtain the final confirmation to the patient. In the event that there is no availability for the day and time reserved, the patient user will be offered an alternative date and time, which could include the use of another available provider of medical services.

Modification of the Contract Terms

The contracting terms may be modified by DrNear.Me at any time, which will be published on the website. The date from which these Contract Terms are in force can be found at the end of the document. The duration of the contract will be until the end of the contracted medical service.

Confirmation email

When making the purchase of the medical service, you will receive a confirmation email that you will provide to the provider of the medical assistance service. This confirmation email allows you receive the Care Service acquired without any additional charge, but only that service. The medical service purchased is not refundable. It can only be redeemed once, and it can only be exchanged at the Medical Center / Hospital in which it has been summoned.

This medical service may be exchanged by the patient user who has made the purchase or a designated third party, prohibiting the resale of the contracted medical service as well as copies or duplication thereof.

The use of the hired medical service for purposes other than those provided in these Contract Terms, leads to the cancellation of it, and exempts DrNear.Me and the Provider of the medical assistance service from any responsibility. In this case, all the necessary actions will be taken by DrNear.Me if necessary.

Once the medical visit date expires, the customer will not be entitled to any refund. Unless the provider of the medical service itself allows it, the reservation of the medical consultation does not entitle the holder to receive the Healthcare Service on a day other than the one contracted, so the patient user must agree with the Provider of the medical service when to receive the medical Service.

In the event that the selected Provider of the medical service is unable to provide the Assistance Service in the agreed conditions, we will contact the client, via email, telephone or by SMS in order to notify them. The patient user will be given the possibility of booking another provider with the available assistance service, or a refund of the value of the purchase made. Price and payment method

The prices shown on the Website are final prices of the products and / or services (exempt from VAT). Prices will be shown in Euros (€). All these amounts will be shown to the patient user in a detailed manner and prior to payment during the purchase process.

Payment is made through credit card, debit card or PayPal and will be charged to the patient’s account at the time of purchase. The patient user will provide the information: Name of the holder, type of card, card number, expiration date of the card or any other that is required during the purchase process. The patient user agrees not to provide false information, including names, addresses and / or contact or payment details, as well as not to initiate any illegal activity in connection with the purchase and not to allow anyone to do so.

To make the payment, the patient user will be redirected to the website of the bank in charge that issued the card, of processing the payment, where they can pay with their debit or credit card safely, Stripe and Paypal payment gateway. Once the purchase has been made on the website by the patient user, the corresponding invoice / receipt will be issued.

DrNear.Me does not have access to or store sensitive data related to the payment method used by the user patient. Only the corresponding payment processing entity has access to this data for the management of payments and collections.

Right of withdrawal, refunds and guarantees

In accordance with the provisions of current regulations on consumers and users, the patient user may, without having to justify his decision and without any penalty, exercise the right of withdrawal 2 hours prior to receiving the medical service from the final provider, Once the service is consumed, there will be no refund of the price of the service, neither total nor partial.

To exercise the right of withdrawal, the patient user must express it by sending an unequivocal communication to the email address patient@drnear.me indicated in these Terms of Contract indicating:

Name and surname of the Client;

Address provided;

Email address used for the purchase.

DrNear.Me will communicate by email the acknowledgment of receipt of the Customer’s withdrawal and will make the refund of the amount of the Code within a maximum period of fourteen (14) calendar days from the day of the withdrawal request.

Any refund will be made through the same means of payment with which the Client made the transaction. In the event that the means of payment has been canceled, expired or has ceased to be valid for any reason, the patient user must notify it to the email address patient@drnear.me. Otherwise,DrNear.Me is not responsible for the reimbursement, so the user patient must contact their bank or payment service provider to process the reimbursement.

The refund will be considered executed if the user patient does not reject it within fourteen (14) calendar days from the date of receipt. The exercise of the right of withdrawal will extinguish the obligations of DrNear.Me with the Client and / or the Assistance Service on which it has withdrawn.

The user patient will have the guarantee of receiving the contracted medical service, on the day and time indicated, with the final service provider being responsible for its compliance. Likewise, Drnear.me has a customer service, sending your request to patient@drnear.me


You may reschedule your appointment free of charge up to 2 hours before the time of your appointment. Rescheduling is restricted to terms and conditions and availability of provider.


Responsibility for the contents

Drnear.me guarantees that the content, data or information related to the services offered on the website are reliable, truthful and accurate. However, these data and information could contain errors and may be modified, both DrNear.Me and its collaborators are not responsible for errors in the contents and possible damages as a result of them.

The photographs, texts, graphics, information, content and characteristics reproduced that illustrate the products and / or services of DrNear.Me are only illustrative, they could also vary. However, their description will be as close to reality as possible.

The services and products of the different medical providers offered on the website are intended to provide the user with different alternatives in a given area, it is the user’s responsibility to select one or the other.

DrNear.Me will not be responsible for the quality of the medical service offered by the final provider, even so it undertakes that the conditions and contracting of the service are met.

The provider of the medical service will be responsible for and safeguard the username and password to access the online platform.

DrNear.Me will maintain the proper functioning of the website, whenever possible, however it will not be responsible for the type of internet connection of the user, as well as for problems, lack of internet supply at any given time, server failures, problems of malware or viruses that third parties have inserted or manipulated to affect the proper functioning of the website.

Video consultation and telephone consultation:

Remote medical consultations, by chat, telephone or videos, will have limitations in terms of physical examination, diagnosis and treatment, as well as factors beyond the doctor and the patient such as internet, telephone coverage, sharpness of images that could be shared, noise third parties and the connection itself, being accepted by the user once the purchase of the service is confirmed, however the service provider may coordinate with the patient user another time, a new appointment in specific cases. 

For the service to be carried out, a good Internet connection will be necessary, it will be your responsibility to configure your computer and information technology programs to access the service.

Remote medical consultations will be carried out by Google meet and other tech supports, following the steps that will be indicated at the time of booking the appointment.

In the event that the medical service provider considers it, it will refer the patient user to medical centers and hospitals for a better diagnosis and treatment of the same.

DrNear.Me is not an emergency medical service. Serious medical problems that can suppose a risk to the life of the patient should be referred to 112 or medical emergency medical services.

Video consultations are useful when people are seeking information about any health needs. Video can be useful in diagnosing some health problems and the Doctor you speak to on video can sometimes initiate treatment and investigations. It is not designed to be a complete health service and there will be occasions when the advice given in a video consultation will result in confirming the need to see a Doctor face to face.


Patients should consider:

You should not use Video Consultations if you think your health problem is urgent or an emergency. 

Video consultations should not be used if you have a medical emergency, such as chest pain, severe abdominal pain, if you have lost consciousness, trouble breathing, among others.

If it is a medical emergency for you or someone by your side, you should call 112.

At the time you make the reservation of the video consultation or telephone consultation, you have explicitly accepted the terms and conditions as well as the privacy policy.

International video consultations and telephone consultations can only be used to provide medical advice. Medical prescriptions, exams, treatments, among others, may not be prescribed or indicated outside the territory where the doctor legally practices.

Patients guarantee they are over 18 years old, and possess the legal right, capacity and ability, on your own behalf, to accept and agree to these terms and conditions. All information must be truthful.

On certain occasions we may carry out identity checks to verify that you are the patient who you say you are, as to show us your ID, if it does not show it, the medical consultation could be denied.

DrNear.Me reserves the right to refuse access to the service. 

Responsibility for contracting the service

Both DrNear.Me and the patient user undertake to comply with their legal and contractual obligations generated under this contract, the user being over 18 years of age.

DrNear.Me will not be responsible in case of unavailability of the products and / or services offered through the Website when this is due to force majeure, theft or loss, or error in the order or data provided by the User, as well as in case of errors, actions or omissions attributable to the Provider of the medical service.

DrNear.Me will make every effort at its disposal to keep the products and / or services available through the Website, except for lack of availability or performance thereof, due to inactivity or temporary unavailability of the Website due to updating and / or technical maintenance of the same, as well as Internet access problems, technological problems, actions or omissions of third parties, etc.

In all the aforementioned cases, beyond the control and due diligence of DrNear.Me, the User will not have the right to any compensation for direct or indirect damages or losses, nor for lost profits.

In the event of closure or suspension, transfer of the Website for reasons beyond the control of DrNear.Me, the User of the service will be informed.

Responsibility for the medical Service

DrNear.Me will not be responsible for delays, defective compliance or non-compliance in the provision of the Assistance Service by the Provider of the medical service. The provider of the medical service will be solely responsible for the medical assistance service, diagnoses, treatments, as well as all the performance and quality of the service, obligations, rights, action or omission, leaving DrNear.Me exempt from any claim, also due to force majeure. , such as: wars, natural disasters, strikes, pandemics, among others that are classified as such.

Drnear.Me will carry out the transfer of the personal data of the patient users to the medical service provider. Being the essential and strictly necessary information for the indicated purpose. Provided that the user has explicitly accepted, as the patient has done, once the medical service has been purchased. The medical service provider will treat the information solely for the purpose of providing the medical assistance required by the patient user, with scrupulous observance of the data protection regulations that are applicable to the medical service provider, preserving and guaranteeing the confidentiality of such information.


Queries or Claims

In the event that the user patient is not satisfied with the medical provider or if they have any complaint or comment regarding the execution of the Assistance Service, they must present their claim directly to the Assistance Provider, not being legitimized DrNear.Me for the receipt of any claim.

Applicable law and jurisdiction

Except for another provision of the applicable legislation, for any litigious issue or that concerns the Website or the contracting of products and / or services regulated in these Contract Terms, Spanish legislation will be applicable, submitting the resolution of all derivative conflicts or related to the use of the Website https://www.drnear.me to the Courts and Tribunals of Palma de Mallorca.
